Dear Sir,
Please help me on following issue.
Case - We pay transportation charges to our transporters. Our transporters doesn't own any Truck. They hire Trucks from various party and provide us for transportation of goods. We deal only with the Transporter for any kind of issue.
Issue - Liability of TDS .
1) Whether the transporter can submit declaration [U/s-194(6)] that they don't own more 10 trucks for non deduction of Tax at Source?
2) What is the meaning of word "OWNS" mentioned in Sec 194 (6)? whether the Transporter can be treated as deemed owner for Trucks operated under their Consignment Note?

1 The transporter who is operating the trucks on hire basis can't submit such declaration.
2 Owns means vehicle purchased and registered in their own name.
