24 February 2012 Query: Since April-2005 Mr.A employed in a company in Dubai-UAE.He joined Y co in india on 01-Nov-2011.
Q: whether Mr.A will be treated as resident or non resident in india?
Whether he is liable to pay tax in india.
whether company is liable to deduct tds on salary payable to him?

24 February 2012 For the FY 11-12 (AY 12-13) Mr. A shall be treated as a non-resident.

However, income earned from the Indian company shall be taxable in his hands as the same has been earned in India.

Further, the employer is liable to deduct TDS if the income exceeds the exemption limit, i.e., Rs. 1,80,000/-.
