13 June 2014 I have One Query.

One Employer is paying salary of Rs. 3,00,000.00 and deducted TDS of 30,000.00 and paid Commission of 10,00,000.00 and deducted TDS of 1,00,000.00

As per me TDS on salary should be deducted on full income as he has knowledge of other income of assessee. So as per me TDS is 2,20,000.0 (30000+100000+90000)as per slab.

What is right?

13 June 2014 well as such yes. if the same employer is paying commission and salary...both should be considered for arriving at net tax liability.

14 June 2014 if you are paying commission & salary to employee then total income will include for tds under the head salary . and deducted the tds after taking investment declaration from employee and add any other income if he/she declare to employer.

18 June 2014 SO IF NOT DEDUCTED ACCORDINGLY SO WHAT STEPS TO TAKE?

18 June 2014 ask employee to pay the tax on his own or u can pay the tax even now but that would attract interest.

For my reference can I get material for reference indicating this provision for deduction of the TDS on whole amount? It is just for referance.
