TDS on Rent

13 May 2011 Hello, Please let me know if TDS is to be deducted in following circumstances: A person has let out two office premises owned by him (situated in different cities) to the same assessee. Though total annual rent from individual premise does not exceed the TDS thresh-hold limit, total rent combined from both the premises exceeds the thresh-hold limit of Rs. 1,80,000 p.a. Does TDS liability arise in this case?

13 May 2011 The tenant of both the premises being the same person, tax deduction attracts subject to section 194I of the Income tax Act,1961.

13 May 2011 Yes TDS to be deducted. Threshold limit is calculated party wise. So if total payment to same party exceeds threshold limit TDS is required to be deducted.
