TDS Not deducted by deductor

if deductor not deduct the TDS but Rent Paid after deduct the amount of tds. in this deductee can receive the amount in cash of TDS from Deductor and paid tax in cash on Total rent income. in this case deductee have any problem ?

If the deductor not deducted TDS deductee not having any problem. he can pay directly tax as self assessment tax

we can take any action against the deductor as he paid rent amt. after deduction tds amount and last he said not deduct tds
