MY ASSESEE IS NOT FILLING HIS TDS RETURN FOR THE 1ST QUARTER TILL NOW.
WHAT IS THE PENALITY FOR LATE FILLING, HE HAS TO PAY RS. 6500 AS TDS

The penalty(late filing fees) will be Rs 200 per day limited to TDS paid( in your case it is Rs 6500).

You can file the return without paying penalty.

but in a book it shows that without paying the penalty(late fee) we can not file the tds return

Not correct. You can file the return without paying the late filing fees u/s 234E.
