18 January 2015 SIR,
MY ASSESEE IS NOT FILLING HIS TDS RETURN FOR THE 1ST QUARTER TILL NOW.
WHAT IS THE PENALITY FOR LATE FILLING, HE HAS TO PAY RS. 6500 AS TDS

18 January 2015 The penalty(late filing fees) will be Rs 200 per day limited to TDS paid( in your case it is Rs 6500).

03 February 2015 but in a book it shows that without paying the penalty(late fee) we can not file the tds return

03 February 2015 Not correct. You can file the return without paying the late filing fees u/s 234E.
