07 January 2010 plz. clarify on following matter

1. where to take exihibition exp. for tds ?
in 194I or 194C - contract or 194-c
advertising ?
(circular 715 dt 8.8.1995) que- 5 clarifies to take it in 194I , que 18 clarifies to take it in 194c .... what to consider and y ??

2. in 194c tds to be deducted on amount including reimbursement of exp. (circular 715 dt 8.8.1995) que- 30

then what to do in bills of logistic charges bills ..is it required to make tds also on payment other than of his services..??

08 January 2010 1. Firstly we have to check what type of expenses covered by exhibition expenses.
If it includes the rent of premises where exhibition held then it is covered in 194I and if it includes the expenses related to advertise the products then it is covered in 194C for advertisement.
All are based on the facts of nature of ledger.

09 January 2010 We have to see the expenses clearly first whether it is rent for exhibition hall aor for other expenses then only we can come to conclusion whether it is 194I or 194C
