One of my client is a transporter and has 18 trucks. He made two partnership firms with 3 trucks in one (the other partner owns 2 trucks) and 15 in the other(other partner owns 3 trucks) owned by him. He is providing his services to a company who is deducting TDS from both of the firms. My question is why the company is deducting TDS from the firm which has less than ten trucks?

You need to make an application to the Concerned Assessing Officer, requesting him to write a letter to the concerned company for NO deduction or lower rate of TDS

I didn't get your point. My question is that weather tds is to be deducted or not as it is a partnership firm and the trucks are not in the name of the firm but are in the name of partners.. And one partner owns more than 10 trucks.. please correct me

You said Company is deducting TDS.....So I gave you the solution.....you can argue all your wisdom with the Assessing Officer and convince him/her that TDS is not required to be done...... If the Assessing Officer agrees, s/he will issue the letter in favour of the said company for NON deduction or lower deduction of tax. Ok?
