05 February 2009 Sir,

Is it require to deduct TDS u/s.194I on payment of rent to Hotel when exceeds Rs.120000/-? We are not reguraly occupying rooms but occassionally booked.

05 February 2009 Yes, TDS is to be deducted for room rent @ 20.6% if the following condition apply.

1. The entire amount is for room rent (not encl., food, service, etc - seperate service and deduct 2.06% TDS on service if the amount excees 20000/- one payment & 50000/- on total aggregating amount)

2. If your are using the same room for the entire year,

3. the amount of rent exceed rs. 120000/-
