i have not filed even today st3 relating to april 2013to sep 2013 H1 of 2013-14 as it displayed TECHNICAL ERROR on that time of filing it
whether we are liable to pay penality Rs 20000/- and account for on the time of filing ST3 or else just file it without penality
please clarify

You need to pay the penalty and then file ST3.

In part K of ST-3, you have to tick mark a statement that'late filing fee' is deposited.
By implication, late filing fee payment is a precondition for e-filing form ST-3.

Sir agree. The return should be filed after payment of late fee but even if we file the return without payment of late fees and not ticking the option as stated by you the return will be accepted. But it is always advisable to file the return after payment of late fees.
