Service tax payable or not..urgent

09 February 2013 Dear all,

If someone is registered under service tax & paying service tax because he is providing services under different person brand name & now wants to start new service not related to brand name & his turnover from both the service is less than Rs 1000000/- than whether the person liable to make payment of service on new service also.

Please clarify on the above matter.

If Entity is Different than no need to pay.

if entity is same than you should pay .

entity is different from the guy who lead all this.

if all the above are in their name than you should pay.

Thank You for yor valuable response & even i think the same way but one of my colleague is stressing on the point that amount of service provided still less than Rs. 10 lakhs & this time they are not into service under brand name.

Please give your suggestion on the same.

12 February 2013 Hi Mr. Sirngh,

You have to consider the limit of 10 Lac also.
means if turnover goes beyond 9 lac than you should take apply for ST No . and when turnover is more than 10 lac you will charge Service Tax.
