Service tax appicability

14 March 2012 we are registered in service tax but the Turn over is Less than Rs.9lakhs but bill includes service tax. whether the service tax is payable by me pls clarify

14 March 2012 1. you are a registered service provider
2. Check whether the aggregate service provided in the previous year is more than 10 lakhs,
3. if point no. 2 is not satisfied than service tax is exempt upto the total receipt of rs. 1000000.

In the given case you have given the turnover of current year please check whether the turnover in previous year is more than 10 lakhs.

15 March 2012 if the turnover is not exceeding 10 lakhs i dont want to pay service tax right..so can i get exempt for paying service tax pls confirm

If turnover is not exceeding 10 lakhs then there is no need to pay service tax

17 March 2012 my turnover is less than 10 lakhs however i have collected service tax @ 10.3% on invoice and so far not remitted. in some cases invoice amount not at all realistic kindly confirm for unrealistic amount whether service tax is payable for unrealistic amount

18 March 2012 Dear Gopalan,
In case where you are not liable to collect service tax and you have collected it then you are liable to deposit it to the govt within the due date. Failing of which attracts interest. It doesn't matter whether realistic or not in your case.

The service tax is to be paid with interest.
