Section 89 of income tax

15 April 2014 one of the income tax professional has been using section 89 to let the Army Personnel take Refund of huge amount of income tax.when i checked the salary slip/form 16 of the army person it nowhere shows the salary recievd in arrears/advance/any amt recieved in voluntary retiremnet. How is the section 89 appicable here???

15 April 2014 u/s 89 ofr relief

when a salary person recd. arrear of last year in current year and tds deducted by deptt/company.

income tax liability is nil of arrear related years.

then after adding arrear in related year if tax liability is NIL or lower .

then you can get tds refund of income tax

15 April 2014 But the army person i am talking about has not recieved any arrears.How come the professional is able to use section 89 then??

16 April 2014 Is there any special treatment in any section of income tax that is only can be claimed by army personnel?? Specially related to section 89???
