the certificate u/s 80d claim submit to employer for deduction of tds but he asked the said certificate filed with return of income by the person concerned. the deduct tds without considering the said claim. what is the proceedure?

The employer should consider the 80D claim for TDS.....if he is not considering then no problem you can claim this deduction while filing your ITR.....and can get the refund...
