whether tds is a duty which should be paid and reported under section 43b of 3cd audit report

No TDS is not the duty and that should not be covered under 43B.
the matters relating to TDS is already covered in sec.40(a) of tax audit as well as its related defaults are covered in clause 27(b).
so TDS should not be covered under 43B.
