Intimation under section 143(1) for the A.Y. 2008-09 issued on 19/08/2010 instead of 30/09/2009, and demand the tax. Is it valid notice or any please help me.

The date of filing the return is also to be known to determine the cut off date as prescribed in the 2nd proviso to section 143(1) of the Income tax Act,1961.
