04 October 2010 I have a query. The recent notifications of application of service tax for residential complex of more than 12 units. If the builder constructs at different places less than 12 units, whether everything will be combined for the application? If the builder constructs after a gap of 3 months this 12 units will be taken as a whole for the year?

Thanks for the reply. My query is, that whether the applicability of service tax is based on the approval of plan. If that so, then if i start different projects of less than 12 units at different municipal limits then the service tax is not applicable?

04 October 2010 a complex a classified residential or comercial as per approval of prescribed authority and when the project gets approved at that time it becomes clear of the picture
a project never gets approval for stages at different times hence at above problem never arise practically
