Renting of immovable property

02 November 2011 As recent judgement of supreme court regarding service tax payment on renting of immovable property.if a person has provided premises to another person and that another person is a member of retailer association of india & due to member he has not given service tax amount to the owner of the premises. owner has no undertaking regarding service tax liabilty from that person & owner has also not issue the bills of rent but recd rent regularly.
now tenant is saying that as you have not issue the bill we have not make the provision and you are out of the judgement of supreme court.
is owner can give reference to dept whenever he will recieve notice.
note: tenant is paying service tax of other owners as they have provided the bill

03 November 2011 It is a vexed issue. Can't comment since the matter is under sub judice of supreme court of India.
