30 April 2011 A PERSON CITIZEN OF USA HAVING RENTAL INCOME IN INDIA

WHAT ARE THE TAX IMPLICATIONS IN INDIA AND AS WELL AS USA.

WHAT CLAUSE OR SECTION WILL PREVAIL.

30 April 2011 Dear Mr. Gupta

as i said he is citizen of usa, he also had his other sources of income in usa, how he will show his rental income in india in usa return and what are relief he can claim in DTAA agreement between india and usa.

I HAVE REPLIED THE QUERY AFTER REFERRING TO SECTION 9 AND DTAA BETWEEN INDIA AND USA
THE ASSESSEE CAN CLAIM DT RELIEF , IF AVAILBLE UNDER US LAWS.
RENTAL INCOME WILL BE TAXED IN INDIA UNDER SECTIONS 22 TO 26 NO TAX IMPLICATION IN USA

10 May 2011 The rental income in India shall also be taxable in US as US laws also provide for taxation of world vide income of US residents/Green card Holders .

However the Indian Taxes paid shall be adjustable against the US taxes in line with India US DTAA on the same.
