One advertising agency(service provider)have service tax registration no. They also do some production jobs like printing brochure, visiting cards, calanders etc, for this production jobs their vendors charging them VAT but the agency charging Service Tax to their clients. kindly suggest me whether the agency need to register with VAT.

Mere advertising is not a taxable activity.But printing visiting card,brochures,calendars attract VAT,either as direct sale or works contract.Hence you need to register with VAT.Service tax should not be charged on sales or material value involved in the works contract.On the charges made for creating concepts,designs,etc only service tax can be charged,if it is chargeable under that Act.
