we are paying service tax on outward freight GTAon 75%.
1) can we take input of it.
2) if we are not providing any other service against which credit taken in 1 so can we claim of refund of duty paid on GTA service if yes refer provision.

We can not take the credit of service tax paid on outward freight because it is not an input service.
But if the outward freight is paid for clearance of from the factory to other branch from where the goods are sold, then that branch will be the place of removal under CENVAT Rules and we can take the credit of service tax in that situation.
Thus credit of service tax paid on the freight paid for clearance of goods upto the place of removal can be taken but not beyond that.
We can not claim refund cenvat credit if we are not providing any taxable service.
