Re-import goods for exported under lut

25 September 2012 Dear Experts,
we are sale our products to DUBAI 01 month back,with out payment of duty against LUT but now buyers wants to return some Products due to quality reason,now that products return back us.
in the mean time customs officer asking whatever earlier we utilized the Duty amount mentioned in the ARE-1, that amount customs officer asking for customs clearance.

in case we have pay the ARE-1 amount.that amount how can refund in our account.
if any producers please guide as earliest.

because products already came to Bangalore air customs.

kindly do the needful.

26 September 2012 Dear Ganesh,

If I understand correctly, Firstly, You have exported your F.G.under UT-1, which is now rejected by the Customs on some quality ground and same is also arrived in India. Now, in this case, you need to pay import duty which you can avail as a cenvat credit OR can apply for Refund under Section 74 of Customs with the help of your CHA.

Both the options are with you to take crdit and apply for Refund. So, please pay the import duty and clear the shipment.
