Proper Itr to be filed in case of an Agent

This query is : Open

Quick Summary
This discussion clarifies the correct Income Tax Return (ITR) form for an individual working as an agent for a finance or insurance company, with tax deducted at source (TDS) under Section 194H. While previously filing ITR-4, the correct form depends on the nature of income and whether books of accounts are maintained. If the income is solely from agency work with TDS under 194H, ITR-3 is generally recommended, rather than ITR-1 which is for salary income.

22 September 2020 A person is employed in a Finance company as an agent where tax is being deducted at source u/s 194H. He does not have other sources of income except that. In A.Y. 2019-20(P.Y. 2018-19), he filed ITR-4. Now what ITR will be appropriate for him ? (He does not maintain Books of Accounts)

22 September 2020 He is employed there ? means he receives pay slip , then it is salary income and he can file ITR 1 if he has no other income.

22 September 2020 from his 26AS, I have seen that tax has been deducted at source u/s 194H. the insurance company has hired him to arrange clients. so he is foing that..

23 September 2020 If tax is deducted u/s 194H, then ITR 3 to be filed.

23 September 2020 thank you so much
