if an assessee pay service tax and interest there upon after 2 years from receving it from client by suo motto, i.e., before SCN is he liable for prosecution service tax new provisions.
amount being less than 50 lakhs , around 3.5 lakhs?

No he is not liable for prosecution as the amount is less than 50 lacs and suo motto complied the provisions.
