GST law does not bar a person whose earlier GSTIN is cancelled from applying for a fresh registration, even on the same PAN, in the same state and with the same trade name.
However, CBIC has instructed officers to examine whether the earlier GST registration was cancelled for non‑compliance and whether liabilities/returns are pending, and they can reject fresh registration if issues are not resolved.
In practice, if past returns are filed and dues (tax, interest, late fees, penalty) are paid, fresh registration is usually allowed.

Before applying, confirm these points for the old GSTIN:
Whether cancellation was:
On your own application (voluntary closure), or
Suo motu by department for non‑filing, wrong details, etc.
Whether time is still available to file revocation of cancellation (FORM GST REG‑21), if you actually want to revive the same GSTIN instead of new one.
Whether all returns up to date of cancellation and final return (if applicable) are filed and all outstanding dues are cleared.
If cancellation was due to non‑filing and you have not regularized, the officer may treat a fresh application as an attempt to bypass old liabilities and can reject it.

Follow these steps for a new GST registration for the proprietor in the same jurisdiction:
Go to the GST portal (www.gst.gov.in) and click New Registration under Services > Registration > New Registration.
Select Taxpayer, choose State and District (same jurisdiction where you want registration), enter Legal Name as per PAN, PAN, email and mobile, and verify with OTP.
In Trade Name, enter the same trade name you were using earlier (allowed, subject to officer verification).
Fill business details (constitution: Proprietorship), place of business, nature of business, additional places, bank details, and upload required documents (photo of proprietor, address proof, bank proof, etc.).
In the promoter/proprietor section, the portal will auto‑link PAN and may show that you had an earlier GSTIN; provide correct details if any field asks about past registrations.
Submit the application with DSC/e‑sign; Application Reference Number (ARN) will be generated.
