31 October 2008 What is the procedure for tranfering PF a/c from 1 employer to another.

For eg. A worked in a company later he started his own proprietary concern. He registers it under the PF Act. Can he transfer his a/c from the company he worked & bring it under his own.

Is there any time frame for this.

31 October 2008 The problem is in a proprietor concern of his he becomes an employer and what he draws can not be salary like an employee. The questionm of his eligibility to PF itself is not arising.

what i mean to ask is say instead of proprietary concern if its a partnership firm can the said partners who receive salary become eligible for PF contribution from the firm on their salary

31 October 2008 Yes if they are working partners drawing salary.

31 October 2008 Sorry to continue this, say the said firm has 3 partners out of which only 1 is working partner, but all the 3 partners draw salary.(I think salary can be drawn irrespective whether they are working partners or not). so can all the partners become eligible for such contribution.

04 November 2008 To continue this, once registered, will the PF & Gratuity act apply to all the employees or can choice be exercised on to whom the said contribution can be made.

eg. an organisation may have office assistants to whom a fixed salary is paid. can contribution to such employees be avoided. Or rather should they be treated as consultants & not as employees.
