19 November 2010 I have received a notice u/s.139 of Income Tax demanding reason for not filing of Return of Income of A.Y.2007-08 and 2008-09. In notice mention that there is an offence of non filing of the Return of Income is punishable by penalty of Rs.5000/- u/s.271F and imprisonment from 6 months to 7 years u/s276CC of the Income Tax A/c.

During the said A.Y. years my total gross income from salary was Rs.60,000/- And Rs.72,000/-

Now tell me how will I reply for the said notice?
Is it mandate to filing the Return of Income of the said A.Y.?

19 November 2010 Have you collected the Form 16 for the Financial years 2006-07 & 2007-08 from your employer?
If your total income is less than the exemption limit, you need not file you return of income, as the IT department does not accept the return(Dept accepts if there is tax payable or refundable)
Caution - Please confirm with reference to your bank account details like interest on FD/SB/RD etc.,

Reply to the ITO, stating that the total income for the A.Y.2007-08 & 08-09 were below the basic exemption limits, hence not filed.
