02 March 2011 i file return of income in A.Y 2003-04.I m LIC Employee and received salary along with form no.16. now before A.Y 2003-04 Rs.105000 incentive given by LIC included in my salary and i offer same for tax.in A.Y 2003-04 LIC withdraw said 105000 from my salary of F.Y2002-03. i file return accordingly showing 105000 as deduction from salary(as per form 16 given by them) Department issue notice u/s 143(1).and then i apply for rectification u/s 154 by given all proof including detail of previose incentive included in my salary and letter from LIC that i offer same for tax and nodedudtion of expenditure claim by me from said income.THey make rectification and issue demand 34449/-without taking into a/c ietter from lic.Now no payment was made by me.

today i received notice from ACIT demanding said amt.now i m confuse whether i should apper before ACIT (as already 7 yr passed).as my case geniune shold i again write letter attaching all proof and demend for rectification u/s 154. or no need to do any thing.

plz guid me abt this URGEnt

02 March 2011 Seems, from the facts given above,that as per income tax records an amount of Rs.34,449/-plus interest is due from you for which they have raised demand now. Your grievances can't be taken up for rectification / revision / appeal since the time limit allowed for such course of action has already been expired. If at all you meet the ITO,I don't think the ITO can help you at this juncture.
I may say that you seek professional advise from a CA / advocate with out delay.
