11 February 2011 how many promoters / first subscribers to MOA are required to incorporate a public company.

whether all subscribers to MOA required to sign MOA personaly or he can authorise any other to sign on MOA ?

12 February 2011 First Subscribers to the MOA - In case of a public company it is 7 ( private company - 2).

Generally speaking the MOA should be signed by the sobscribers. The Deptt. of Company Affairs has however clarified that MOA may be signed by an agent, if authorised by a POA.

12 February 2011 so MOA should be subscribed by all share holders. minimum no. of subscriber in case of public co. shall be 7.

12 February 2011 Yes, to form a Public Company at least 7 persons shall subscribe their names to a Memorandum of Association and they shall also comply with the other formalities in respect of the registration of the company under the Indian Companies Act, 1956.
