Hello, if an articled assistant has taken excess leave then his articleship period shall be extended by the same duration. But can anyone tell me if an article has taken transfer and under his previous principal has taken leaves less than that allowed. will he be entitled for the taking remaining leaves (that under previous principal) under new principal/industrial training??

When an articled assistant takes a transfer from one principal to another, or from a principal to industrial training, the rules regarding leave can vary based on the specific regulations set by the Institute of Chartered Accountants of India (ICAI).
Generally, the ICAI guidelines stipulate that the total period of leave allowed over the entire articleship is cumulative. This means:
1. **Accumulated Leave**: If you have served under a principal for 2 years and have not utilized your full entitled leave during this period, the unused leave does not automatically carry over to your time under a new principal or during industrial training.
2. **Leave Entitlement**: The leave entitlement usually resets or is re-evaluated when you transfer to a new principal or start industrial training. Therefore, any unused leave from your previous principal generally does not roll over.
3. **Extension of Articleship**: If you take excess leave beyond what is permitted during your entire articleship, the period of your articleship may be extended by the duration of the excess leave. However, this applies to the total leave taken, irrespective of the principal or training you are under.
For precise guidance tailored to your specific situation, itโs always best to refer to the latest ICAI regulations or consult with the ICAI directly. They can provide the most accurate information based on your individual circumstances and any recent updates to the rules.
