Late filing of DIN 2 and DIN 3

28 October 2009 Sir,
if after getting DIN, Directors have not filed DIN 2 with Company and further Company has not filed DIN 3 with RoC,
1. what if company files DIN 3 today?

2. Any penalty?

3. What will be beneficial for Pvt. Ltd. Co.: -
a. Taking back dated DIN 2 Forms from Directors and making it default in Company's Name or
b. Taking current dated DIN 2 and making it default in name of Directors?

4. Will DIN status have any effect on Annual Filing of previous three years Returns with RoC?

28 October 2009 1) if company file DIN 3 now then it has to pay addtional fee for delayed filing.

2) additional fee

3) it will be beneficial to take DIN 2 back dated bcz within 30 days of approval of DIN, directors are supposed to inform to company and company is supposed to file DIN 3 with 7 days after getting DIN 2.

4)if you have filed then no effect, you just pay addtional fees for DIN 3 and get it registered with MCA i.e. do roll check.
