Late filing fees u/s 234e

Recently income Tax department sending demand letter claiming huge amount of late filing fees u/s 234E even to the educational institution who have not any fund to pay this fine at all.These are the non-trading concern.
Question is that whether these institution can file any suit to high court ?

No specific provision for relief from penalty u/s 234E. Still you can make an application to your Tds jurisdiction requesting for waiver and see what happens.
