Itr2

This query is : Resolved

11 August 2016 I am filing ITR2 .I am a pensioner (retired naval officer) receiving pension from government.Recently out of court order I received compensation from my old employer(joined after retirement from Navy). The compensation amount is clearly referred to as Capital receipt by the high court and have ordered no TDS on this amount and have ordered IT to refund the amount debited by the employer.I am mentioning the compensation amount as exempt income in ITR2.

Kindly inform me should I mention the pension amount as Salary..If yes what should I fill in schedule S of ITR 2.....as Name of the employer ...PAN number...address..since its central government.

11 August 2016 you may write the name of DISBUSRSING authority in the space provided for employer.

11 August 2016 Thanks for the reply sir.
Sir as I mentioned I received compensation via court order in which court clearly stated no TDS as its capital receipt but the company played mischief and debited the tax and shown the amount under salaries head in 26a.The court directed in the order to IT to refund the tax.Now am filling my returns in ITR2.I am trying to mention the compensation amount in Schedule EI ,others in ITR2 but the ITR2 java is giving me error" Income reported in BTI is less than 90% of the income mentioned in TDS1". Since am claiming the compensation back am mentioning only 30% of the income as mentioned in 26a by my old employer. If I mention the full compensation in Schedule S as salary and also similar amount in exempt income its not showing me refund.
Kindly inform me how I can mention the compensation in right way so I can claim the refund via ITR2.

11 August 2016 please go one by one.......
01. pension you fill in the sheet named as SALARY....ok?

11 August 2016 Sir I if u can explain how to mention compensation under TDS sheet under salary as you mentioned in you reply.I am not clear how to do this. The compensation and pension amount is already mentioned in TDS sheet with tax deducted.

11 August 2016 Ok. Let me try.
Since compensation as well as pension is FILLED in TDS sheet, now what you have to do is FILL pension in SALARY sheet and FILL compensation in EI sheet, item 5 viz others.
This should work.....
