Is amount refundable on deduction made @30%

19 June 2012 Respected Members',
If any TDS made on winning from game show @30% can the winner claim TDS as refund if he/she does not have taxable income for the relevant previous year.Does any game show normally take the PAN NO.from the winner of the show to deposit the TDS.I do not have any clear idea in this matter.
Please suggest.

20 June 2012 1. You have to provide your PAN to the organisers.

2. If the assessee does not have any taxable income, even then he is NOT eligible for refund.

This is so becuase winning from lotteries is taxable at a special rate of 30%. Benefit of slab rate is NOT AVAILABLE against such income.

Even deduction under Chapter VIA (80C, 80D, etc.) are NOT available agaunst such income.
