26 August 2010 Experts,

I (partnership firm) received notice from the Income Tax Depertment for Income Tax Securtny for the Assessment year 2008-2009 from ward-1 income tax officer.(He sent me notice on the basis of selection of case by the Banglore department, because the address given in the form 49A, pretains to this ward). and before compulsory online filling, I was regularly filling my return in ward-2 on the basis of address. At present the situation is that both the officers wants to finalise my case. what should I do. (from officers point of view, both are known to me).

Now the bangolre department again selected my case for securtny for the A.Y. 2009-2010, for which I received notice from Ward-2.

Please guide me, which ward is right one for finalisation of my case.

27 August 2010 The case should be presented before the officer who have issued the notice as per jurisdiction. if there is change in jurisdiction due to some reason, the same should be resolved with the help of additional commissioner of the range. it is difficult to understand how both officer can make the assessment

27 August 2010 Sir, Jurisdiction as per current business address or as per PAN address because PAN address is of my residence.

27 August 2010 If there is dispute, in my opinion, jurisdiction should be according to the PAN address, i.e., jurisdiction shown in income tax portal (if the address is existing and assessee is residing at that address which must have been mentioned in partnership deed also as the address proof for partnership firm is the address as shown in the deed.
