12 August 2011 Hi,

I am paying housing loan interest from april to march and the house is occupied in jan.

So i claimed HRA till December and availed housing loan interest benefit for the entire year.

I got a notice saying i can't get housing loan interest till jan because the house is occupied by me till dec and claiming HRA.

IS it correct and is there any case law for this to claim both the benefits.

12 August 2011 Yes. Observation in the notice is correct by virtue of the explanation to section 24(b) of the Income tax Act,1961.

12 August 2011 so i can claim HRA till dec and housing loan interest for Jan to March?

If that's the case is there any case law for this!

How should go further regarding this matter.
