filing of vacancy of auditor occurs due to resignation

06 July 2011 hi,can anybody tell me this if causal vacancy is caused by the resignation by auditor of a company then shareholders are required to fill this vacancy in which meeting?is it general meeting or extra ordinary general meeting?

lets say causal vacancy occured on 1st sept.,2002 and AGM is going to be held on 28 sept.,2002 then auditors going to be appoint in GM or in EGM? please help.its urgent.

07 July 2011 There is no GM and EGM. There is only AGM and EGM. You need to fill vacancy by EGM.

In your case, It is in AGM.

15 July 2011 As per proviso to Sec.224(6)(a) vacancy caused by resignation of an auditor has to be filled by the co. in general meeting only.
so it may be either EGM or AGM.
