01 August 2011 Assessee havent filed, his ITR - 4 for AY 2010-11, & income exceeds the exemption slab. so can we file the return ,if yes then what is the last date for filling

01 August 2011 Yes you can still file the return, you only have to pay penal interest for late filing of return. Thats it.

Last date to file the same is 31/03/2012, if the income is over the minimum taxable limit.

01 August 2011 Actual due date of filing for Income tax return 31.7.2011 for the ay-2010-11, so already due date over. even you can file the return as belated return u/s.139(4)

01 August 2011 Penalty can be initiated under section 271 F for not filing the return on or before the end of assessment year ie 31/03/2011.

N.B :- A.Y in the query is presumed as assessment year relating to the previous year begining from 1/4/2009 to 31/03 2010.

01 August 2011 In previous replies , they said we need to pay only interest as penalty , so i m bit confused , in reagard to penal interest & Penalty as u/s 271 of IT Act. kindly clarify please,,,,,,,,,,,,

01 August 2011 271F is applied only if the return is not filled till the end of the relevant A.Y. i.e. till 31/03/2012 as i said in the earlier answer.

If a person who is required to furnish a return of his income, as required under sub-section (1) of section 139 or by the provisos to that sub-section, fails to furnish such return before the end of the relevant assessment year, the Assessing Officer may direct that such person shall pay, by way of penalty, a sum of five thousand rupees.]
