18 February 2014 My client has received order to pay late fees of 60000 for late filling of tds return for Q-1. Now I am in dilemma is it pay fees or file appeal against order or make writ into HC for validity of section 234e ? keral a high court order stay on same issue . Should I wait for final disposal of appeal in Keral HC ? If in Kerala High court decision remains in favor of assessee then same decision apply to all taxpayer in india or it is valid in Kerala Jurisdiction only ? Please give suggestions its urgent.

18 February 2014 and if you are not in Kerala, then you can also file a writ on your own in jurisdictional high court.

19 February 2014 I advise at first go for rectification and at the same time file an appeak before CIT(A) so as to argue the matter.
In the meantime...chk the TRACES justification report....for the mistakes..if any....
