Excise duty on precast material

06 June 2009 We have sent up plant called Precast Plant containing mainly casting yard and gantry. We prepare walls and slabs from cement, sand etc. and use the same for preapring residential units for selling purpose in the same entity.
Whether excise duty applicable on the saem. If yes, under which classification/notification
Second query is if we do jobwork for some other entities and make precast material from there raw-materials. Are we liable to pay service tax OR excise duty.

07 June 2009 The same is liable for central excise duty maybe in 94/96 chapters.[ do not have the access to shcdule now] please check in cbec.giv.in site in those chapters.
Under central excise manufacturer is liable and not the raw material supplier therefore in this case even for job work you wouldbe liable for the value of the job work + value of the materials.
Can become quite substnatial.
Credit of cemenet and steel etc would however be available as set off.
