Excise duty can be passed by a trader who purchase the goods

One of my client is trader who purchases goods from second stage dealer. he want to pass on the duty so, is it possible to pass on the duty?
pls. reply as early as possible.

It is not possible. The cenvat credit can be passed upto the second stage dealer.

but my client is telling that one of the consultant said him that he can pass on the credit because he is the trader and not the ultimate consumer. i dont have any answwer for that. pls reply.

You know the defenition second stage dealer. Second stage dealer means a dealer who purchase goods from a first stage dealer. Rule 2(s) of cenvat credit rules dealer of any subsequent stage after second stage cannot issue cenvatable invoice.
