20 February 2016 TDS was not applicable on Transport charges in the FY 12-13 ; so we have not deducted TDS on Carriage Outward charges and in the quarterly e-tds return we have not flag the transporters name who's tds was not deducted Because of this technical non compliance ; Can IT officer disallow the whole expenses?

20 February 2016 1)Yes TDS return filing mandatory but A.O . cannot disallow expense just because not shown in TDS return.(hope you obtained PAN of transporters)at the time of payment to them.
2)Fee u/s 234E will be Nil as TDS deducted is Nil.
