ON WHAT BASIS THE NATURE OF SALARY BEING DECIDED ?

1. TDS on the Directors' Remuneration in the nature of salary will be deducted u/s 192.
2. The directors remuneration which is not in the nature of salary will come u/s 194J
Generally, the executive directors get fix monthly remuneration and the payment to them is made in course of employment and TDS u/s 192 will be deducted and TDS will be deducted u/s 194J in case of non executive directors who get sittting fees/ professinal fees etc

CAN WE DEDUCT tdS UNDER 194J , IF WE WANT TO ,CURRENTLY IT IS BEING DEDUCTED UNDER SEC 192 ..

No, Salary/Remuneration to executive directors will be deduted u/s 192 only.
