Delay in filing return by 5 minutes

01 October 2013 Respected Sir/Madam,

I have filed return of company at 12.05. However such return was delayed due to technical errors of Income Tax site. Since return in not filed within due date We cannot c/f loss. Is there any provision through which we can communicate our problem or represent our side to CPC Bangaluru.
But 29 B Annexure was uploaded before time.
Please guide me for this case.

01 October 2013 It was held in case of Lodha builders that they had filed 1 day return late and loss wasnt allowed to be c/f but they wrote a letter to cbdt u/s 119(2)(b)seeking relief,

so you also need to prove the facts on paper and under sec 119(2)(b) make an application to cbdt.

This was genuine problem which was faced by not only by us but so many assessees across the country due to technical error in Income Tax site. So Whether I need to make application to Assessing Officer or someone else? and please tell me what is the procedure?

02 October 2013 first u meet your jurisdictional assessing officer and see whether he resolves your issues or not if not then wirte a letter to cbdt u/s 119(2)(b) and seek relief qouting lodha builders case i mentioned above.

It seems that the above provisions mentioned in your reply are related to refund cases which is mentioned in the circular issued by CBDT. However in our case loss return was filed by 12.05 AM and there is no refund. Kindly suggest the remedy.

03 October 2013 pls refer to sec 119(2)(b) it also refers to power of cbdt incase if assessee is facing genuine problems also.
