deduction of TDS

18 July 2008 If a person providing contractual service and professional service to the same client, then on which amount TDS Should be deducted for eg
a)If a person provide Contractual service worth Rs 15000 and professional Service worth Rs 17000, should TDS be deducted.

18 July 2008 These are two different contracts. One is covered by 194C while other is covered by 194J. The amount received under both the contracts is below the limits specified under the respective sections. As such, tax at source is not required to be deducted.

18 July 2008 but only one invoice is issued by the party and the total of which is exceeding Rs 20,000???????. However as per Income Tax Act, if any payment made exceeding Rs 20,000 for Contractual and professional service TDs Should be deducted, it is mere silent on the issue related the combination of both in a single invoice.

18 July 2008 if you do not want to deduct be prepared to prove that these are two independent agreement
