12 February 2014 Dear Experts

Please guide me.

I am undergoing 15 months training in a Company and have completed 9 months. My appointment letter says that if I plan to leave, I will need to serve a notice period of 30 days.

Just to inform you that I am expecting and hence would not be able to continue the training as the office is quite far and the journey involved is too long.

Please confirm if I need to serve the notice period to get an NOC and I can get the same without any notice period.

PLease reply

20 July 2024 If you are undergoing training in a company and your appointment letter specifies a notice period requirement for resigning, typically you would need to serve this notice period to formally resign and obtain a No Objection Certificate (NOC) from the company. Hereโ€™s how you can approach the situation:

1. **Review Appointment Letter**: Carefully review your appointment letter to understand the exact terms regarding resignation and the notice period required. The notice period is a contractual obligation that you agreed to when you accepted the training position.

2. **Notice Period Requirement**: If your appointment letter states that you need to serve a notice period of 30 days before resigning, then you are generally obligated to fulfill this requirement. This means formally notifying your employer of your intention to resign and working for the specified notice period.

3. **Requesting NOC**: Typically, companies issue a No Objection Certificate (NOC) after you have completed your notice period and fulfilled all exit formalities. This certificate states that the company has no objection to you leaving and may be required for future employment or academic purposes.

4. **Special Circumstances (Pregnancy)**: Given your special circumstance of pregnancy and the challenges with commuting to the office, it would be advisable to discuss this situation with your employer or the HR department. They may consider your situation sympathetically and could potentially offer a solution such as adjusting your work location or allowing for early termination with minimal or waived notice period.

5. **Communication**: Initiate a conversation with your immediate supervisor or HR representative to explain your situation clearly. Request their understanding and discuss possible options, including the feasibility of waiving the notice period or finding a mutually agreeable solution.

**Formal Resignation**: If an agreement is reached to waive the notice period, ensure that you submit a formal resignation letter stating your intention to resign and requesting an NOC. This should be done in writing to maintain clarity and record of communication.

In summary, while the standard procedure would involve serving the notice period as per your appointment letter, your specific circumstances may warrant a discussion with your employer for a more flexible arrangement, especially considering your pregnancy. Engage in open communication with your employer to find the best solution that suits both parties.
