DEAR SIR .
I NEED YOUR EXPERT OPINION . ONE OF MY CLIENT SMT RAXABEN BACHUBHAI PRAJAPATI IS A PRIMARY SCHOOL TEACHER . THIS YEAR SHE GETS ARREARS OF SALARY SO AFTER CLAIMING 89 RELIEF SHE STILL REQUIRED TO PAY TAX ON HER INCOME . BESIDES THIS SHE HAS PAID RS 50000 U/S 35AC CERTIFICATE OF EXPENDITURE NOTIFIED U/S 35AC IN FORM NO 58A AS PER RULE 11-0(1) HAVE BEEN RECEIVED .
MY QUESTION IS CAN SALARIED PERSON CLAIM SUCH CONTRIBUTION FROM SALARY INCOME OR THIS IS FOR ONLY THOSE WHO ARE CARRING BISINESS OR PROFESSION .

The deduction u/s 35AC is not available for the person having income from salary.
The deduction is available only from income from business & profession.

There are different heads under income tax act for charging income tax. If a section falls under a particular head then deduction is available only from the income chargable in that particular head only.
