09 July 2011 Whether a steel manufacturing company whose plant is under construction can claim cenvat credit of Excise & VAT on the purchase of fire clay bricks ? Moreover, VAT credit should be taken for Fly ash bricks or not by the same company.

11 July 2011 No bar in availing Cenvat credit of Excise / VAT on Firebricks (capital goods) during construction period. Appropriate records eg: 23C PartII & Input Credit register, to be maintained as & when Cenvat credit is utilised.

For availing VAT credit on Fly ash bricks, it must be supported by valid duty paid documents.
