25 December 2012 we have an issue regarding closure of a pvt ltd company which is registered under central excise as manufacturer.
The company has been dormant since past 6 months having declared stock worth 1 crore,
due to the financial crunch we have decided to vacate the rented factory premises, and shift the existing stock to certain storage area.

1.is it necessary to apply for excise registration for the new premises as it comes under different jurisdiction.

2. we are in the urge of closing the company but due to declared stock should we continue with the excise until the stock is dissolved.

26 December 2012 If storage are is in same premises then no need to take new registration. New premises then it should be registered.

thank you very much.

we hereby have one more issue for the above said company regarding excise.

1. the company being dormant from june 2012 till date no returns have been filed.

2. the comapny had cenvat credit balance of around rs 18lakhs.

3. on filling the pending returns till date can we file nill return till jan 2013 and consider balanced cenvat credit in the month of feb 2013.

4.or should we file regular return for the pending months from june 2012 till date by only considering cenvat credit balance.

5.the company is dormant since 2012 may.

kindly provide me with a suggestion.

16 January 2013 You have registered with excise then filing of return is mandatory. Excise department can impose the general penalty of rs. 5000 if you have not file the return within time limit. You can take the cenvat credit if you have to pay the duty. You can file the return from june 2012 to jan 2013. If you have any query visit on my profile and contact with me.
