FBT

is surcharge levied always on FBT or it is levied when total income is more than 1 crore in case of Firm / Companies?

Facts-
Assessee is private limited compnay with main object of trading in properties and having stock of land & building. The assessee earned rent of Rs. 7,29,000/- from building held in stock as on 31.03.2009.

Question-
Whether above Income is to be treated as Rental Income OR Business Income

Section 269SS and 269T

With modernisation of banking, what is the position of the following transactions reading 6DD and 269SS and 269T:-
1) Payment of expenses of over Rs.20,000 by Credit Card, NEFT or RTGS or electronic transfer in same bank.
2) Acceptance of Loan above 20000 by NEFT or RTGS or electronic transfer in same bank.
3) Repayment of Loan above 20000 by NEFT or RTGS or Electronic Transfer in same bank.

Are the NEFT / RTGS / Transfer considered as account payee transactions. Banks like ICICI call them E Checks.

Question of taking third party loan or repayment of third party loan by credit card does not arise and therefore not mentioned in 2 and 3 above.

Refund of Share Application Money

Hi,
Can a Pvt. Ltd. Company refund some part of share application money, if shares are pendining to allotment? And same money is received from foreign?
Please answer as soon as possible with section, because this is required for TAX AUDIT.

Capitalisation of fixed assets

Dear All,

In my one manufacturing unit,which is situated out of the city area I have incurred about Rs. 08.00 Lacs for fencing a electircity line from city to the unit.

What I shoud do I treat this a capital Expenditure and capitalise in Electric installation r treated as deferred revenue expenditure and w/oo in 5 installment.

This is new Industry and estalished in April 2008.

TDS on Rent of commercial Property

Can someone tell me that at what rate bank can deduct TDS from my rent as I am indivisual.
Bank is still deducting 16.995% TDS in current year whether is legal
